नवीन समाजमाध्यम वावर नियमावलीच्या अनुवादात साहाय्य हवे
२६ मे २०२१ पासून लागू झालेल्या (मिपासारख्या समाज माध्यम संस्थळांनाही) नियमावलीतील खालील अंशाच्या मराठी अनुवादात साहाय्य हवे आहे.
Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules 2021
PART I Definitions.—(1)
(w) ̳social media intermediary‘ means an intermediary which primarily or solely enables online interaction between two or more users and allows them to create, upload, share, disseminate, modify or access information using its services;
(x) ̳ user‘ means any person who accesses or avails any computer resource of an intermediary or a publisher for the purpose of hosting, publishing, sharing, transacting, viewing, displaying, downloading or uploading information and includes other persons jointly participating in using such computer resource and addressee and originator;
(y) ̳user account‘ means the account registration of a user with an intermediary or publisher and includes profiles, accounts, pages, handles and other similar presences by means of whicha user is able to access the services offered by the intermediary or publisher.
3 PART II . (1) (b)
(i) belongs to another person and to which the user does not have any right;
(ii) is defamatory, obscene, pornographic, paedophilic, invasive of another‘s privacy, including bodily privacy, insulting or harassing on the basis of gender, libellous, racially or ethnically objectionable, relating or encouraging money laundering or gambling, or otherwise inconsistent with or contrary to the laws in force;
(iii) is harmful to child;
(iv) infringes any patent, trademark, copyright or other proprietary rights;
(v) violates any law for the time being in force;
(vi) deceives or misleads the addressee about the origin of the message or knowingly and intentionally communicates any information which is patently false or misleading in nature but may reasonably be perceived as a fact;
(vii) impersonates another person;
(viii) threatens the unity, integrity, defence, security or sovereignty of India, friendly relations with foreign States, or public order, or causes incitement to the commission of any cognisable offence or prevents investigation of any offence or is insulting other nation;
(ix) contains software virus or any other computer code, file or program designed to interrupt, destroy or limit the functionality of any computer resource;
(x) is patently false and untrue, and is written or published in any form, with the intent to mislead or harass a person, entity or agency for financial gain or to cause any injury to any person;

(२) (b) The intermediary shall, within twenty-four hours from the receipt of a complaint made by an individual or any person on his behalf under this sub-rule, in relation to any content which is prima facie in the nature of any material which exposes the private area of such individual, shows such individual in full or partial nudity or shows or depicts such individual in any sexual act or conduct, or is in the nature of impersonation in an electronic form, including artificially morphed images of such individual, take all reasonable and practicable measures to remove or disable access to such content which is hosted, stored, published or transmitted by it
उपरोक्त नमुद नवीन नियमावली अनुसार, समाज माध्यम संस्थळांनी व्यक्तिंच्या खासगीपणाचा भंग करणारा मजकुर लौकरात लवकर वगळला जाण्याची व्यव्स्था करणे. तसेच गार्हाणे (तक्रार) अधिकार्याची नेमणूक करुन २४ तासात गार्हाण्याची पोच देणे आणि १५ दिवसात निपटारा करणे अभिप्रेत आहे असे दिसते. * नवीन समाजमाध्यम वावर नियमावली मोठ्या समाजमाध्यमात वावरतानाही लागू होते हे लक्षात घ्या अर्थात हा धागा मुख्यत्वे मिपासारख्या लहान समाजमाध्यम संस्थळांच्या दृष्टीने काढला आहे.
* हा धागा अतीमोठ्या समाजमाध्यमांबद्दल नाही कायदेशीर दृष्ट्या मिपासारख्या लहान प्लॅटफॉर्मला लागू न होणारी, अनुषंगिक नसल्यास त्यांची चर्चा या धाग्यात टाळावी. तसे करण्यासाठी अनेक आभार.
